Terms of Service

1. Accepting these terms

eTap is a brand of Ethos Concepts, based in Nairobi, Kenya ("we", "us"). By creating an account or buying a card you agree to these terms, our Privacy Policy and our Refund Policy. If you do not agree, please do not use eTap.

2. The service

eTap lets you create a digital business card with a QR code that people scan to get your contact details. On the Dynamic plan you also get a live card page you can share and update. You can order a physical NFC card that opens your card when tapped on a phone.

3. Your account

• You must be at least 18 years old to use eTap.
• Give us accurate information and keep it up to date.
• Keep your password safe. You are responsible for activity on your account.

4. Plans and pricing

• Static plan: KES 1,500 one-time. Your contact details are stored inside the QR code. There is no subscription, and the details cannot be edited after payment.
• Dynamic plan: KES 5,800, which includes the first year, then KES 2,900 per year. You can edit your details at any time.
• All prices are in Kenya Shillings and include 16% VAT.
• We may change our prices. A change never affects a period you have already paid for, and we will give you notice before it applies to your next renewal.

5. Renewal and expiry (Dynamic plan)

Renewal is not automatic and we never charge you without your action. You renew by making a new payment by M-Pesa or card. We email you reminders 30 days and 7 days before your subscription expires, and again on the day it expires.

After expiry you have a 3-day grace period in which your card keeps working. If you have not renewed by the end of the grace period, the card is deactivated, its page shows an inactive notice, and we send you a final email. You can renew later to reactivate it.

6. Physical cards and delivery

Once your payment is confirmed, our team reviews your card details and design. A physical card is produced only after we approve it. Delivery is arranged with you separately, and delivery charges are not included in the plan price.

7. Custom design service

You can upload your own card design, or pay KES 3,480 (VAT inclusive) for our designer to create one with you. You must have the right to use any logos, images, or artwork you send us.

8. Acceptable use

You must not use eTap for content that:

• is unlawful, fraudulent, or misleading;
• infringes anyone's copyright, trademark, or other rights; or
• impersonates another person or business.

We may suspend or remove a card that breaks these rules, and we may refuse to print it.

9. Your content

You own the details, photos, and logos you add to your card. You give us a non-exclusive licence to store, display, and print that content, only so that we can provide eTap to you.

10. Our intellectual property

The eTap and Ethos Concepts names, logos, card designs, website, and software belong to us. You may not copy or resell them without our written permission.

11. Availability

We work to keep eTap running, but we cannot promise it will always be available or free of errors. We may pause the service for maintenance, and we depend on third-party providers for hosting and payments.

12. Limitation of liability

To the extent Kenyan law allows, we are not liable for indirect or consequential losses, such as lost business or profits. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under Kenyan consumer protection law.

13. Ending your use

You can stop using eTap at any time and ask us to close your account. We may suspend or close an account that breaks these terms. Refunds, if any, follow our Refund Policy.

14. Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute.

15. Changes to these terms

We may update these terms. We will post the new version on this page with a new date and email you about important changes. If you keep using eTap after a change, you accept the updated terms.
